Data Recovery Terms & Conditions
Data Recovery Guarantee: Data recovery cannot be guaranteed as data may be corrupted or damaged past the point of salvation. Data recovery attempts may result in a loss of software, directory structures (such as email folders and contact lists), documents, file names, photographs, music, movies and any saved settings. In addition, we may only be able to retrieve a portion of your storage media. Success largely depends on the existing condition of your laptop, your hard drive or storage media. If we are unable to complete the recovery, a diagnosis fee would still apply. In addition, a recovery attempt fee applies in the case of recovery attempt from mechanical failures. In all cases, full or partial data back-up and/or recovery are not guaranteed.
Authorisation: TMM reserves the right to use third party data recovery services to fulfill your data recovery request and you authorize us to accept on your behalf the terms and conditions of such engagement. You also authorize us to transport your media and/or laptop to, from and between our locations and the premises of our data recovery agent.
Legal Rights: You warrant that you are the legal owner, representative or otherwise of the storage media and/or laptop and that you have legitimate rights to the property and data contained therein.
Limited Liability: We shall not be liable for any claims regarding the physical functioning of media and/or laptop or the condition or existence of data on storage media supplied before, during or after service. We are not liable for any direct or indirect damages, including loss of data, loss of revenue, incidental or consequential, before during or after service.
Payment: All recovery fees are due in full upon completion of a successful recovery, prior to release of any data (whether shipped, picked up or downloaded) unless by special previous arrangement. Additional fees will apply if the use of a debt recovery agent is required.
Confidentiality: We agree to non-disclosure of any and all information or data files supplied with, stored on, or recovered from your media and/or laptop unless required by law
